Nothing in this Agreement shall be deemed to confer any thirdparty rights or benefits. MakigoHost may, in its sole and absolute desire, change or modify this Agreement, and any policies or agreements at any time, and such changes or modifications shall be effective right after signing up with us. Your use of this Site or the Services after such changes or modifications been made shall constitute your acceptance of this Agreement as last revised. If you do not agree to be governed by this Agreement as last revised, do not use (or continue to use) this Site or the Services. Also, MakigoHost may periodically alert you of any changes or modifications to this Agreement by email. It is therefore very important that you keep your account (“Account”) information current.

1.0 Account Eligibility

Our products and Services are available only to Users who can form legally binding contracts under applicable law. By registering for or using the Services, you represent and warrant that:
You are eighteen (18) years of age or older. The Services are intended solely for Users who are at our age limits which is (18). Any registration, use of or access to the Services, by anyone under eighteen (18) is unauthorized and is a violation of this Agreement. If you use the Services on behalf of another party you agree that you are authorized to bind such other party to this Agreement and to act on such other party’s behalf with respect to any actions you take in connection with the Services. It is your responsibility to provide accurate, current, and complete information on the registration forms, including an email address that is different from the domain you are signing up under. 2.0 Registration and accounts

2.1 Your account will be created base on the credentials provided by you.
2.2 You must not allow any other person to use your account to access the website.
2.3 You must notify us in writing immediately if you become aware of any unauthorized use of your account.
2.4 You must not use any other person’s account to access the website, unless you have that person’s express permission to do so.

3.0 User login details

3.1 Your user ID must not be liable to mislead and must comply with the content rules. you must not use your account or user ID for or in connection with the impersonation of any person.
3.2 You must keep your password confidential.
3.3 You must notify us in writing immediately if you become aware of any disclosure of your password.
3.4 You are responsible for any activity on our website arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

4.0 Cancellation, suspension and Account Deletion (Perminemt)

4.1 We may:
(a) Suspend your account;
(b) Cancel your account; and/or
(c) Edit your account details at any time in our sole discretion with or without notice or explanation.
4.2 You may also cancel your own account on our website using your account control panel on the website.

4.3 If your account remains inactive for 90 days without renewal - After this period, your account — including all associated files, folders, and data — will be permanently deleted. Storing inactive accounts incurs high costs, and we are unable to keep them indefinitely. To avoid data loss, please renew your hosting as soon as possible.

5.0 LIMITATION OF LIABILITY

MakigoHost shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from MakigoHost servers going off-line or being unavailable for any reason whatsoever. Furthermore, MakigoHost shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of MakigoHost servers. All damages shall be limited to the immediate termination of service.

6.0 Identity Verification

We carefully evaluate new accounts to determine high risk orders. Please do not take it personally if you are asked to verify a new account as you may have been selected randomly. Please provide the requested information at your earliest convenience to ensure that your account is set up as soon as possible.

7.0 Billing

At this time we bill monthly and annually, depending upon the plan. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund (For some special offers the money back guaranteed day will be varied; and Domain Name registration fee is non-refundable). We accept Visa, Master Card, MTN and VODAFONE MOBILE MONEY American Express, Discover Card (PayPal). For Webhosting plans we will setup your account after the invoice is paid. Clients are encouraged to pay by Card as it is the easiest way to handle payment at this time. There are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.

8.0 Late Payment and sanctions

Pending invoices must be paid within seven (7) days of the invoice due date. Any invoice that is outstanding for more than seven (7) days may result in the suspension or termination of Services. Access to the account will not be restored until payment has been received. If you fail to pay the fees as specified, MakigoHost may suspend or terminate your account and pursue the collection costs incurred by MakigoHost, including without limitation, any arbitration and legal fees, and reasonable attorneys' fees. Late payment of invoices may attract a late fee

8.1 Account Suspension and Data Deletion

Accounts suspended for non-payment may be permanently deleted after (6) months from the invoice due date, unless prior written arrangements have been made with MakigoHost. Maintaining expired or inactive websites is costly, and as such, MakigoHost cannot indefinitely retain data for unpaid accounts. Once deleted, data recovery is not guaranteed and, if available, may incur additional fees including recovery and late payment charges. Clients are solely responsible for ensuring that payments are made on time to avoid suspension or data loss.

Clients who know they will not be renewing their hosting services within 6 months are strongly advised to download and back up their data in advance, as MakigoHost cannot guarantee long-term retention of expired accounts.

9.0 Pay in advanced

We give you the ability to deposit funds in your accounts with a minimum of ($5) and a maximum of ($500) It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You agree to pay for the Services in advance of the time period during which such Services are provided. Subject to applicable laws, rules, and regulations, payments received will be first applied to the oldest outstanding invoice in your billing account

10.0 Refund Policy

Products and services eligible for a refund, you may request a full refund within thirty (30) days of purchase (“Refund Period”). In the event you purchase a product that includes a free domain name, if you cancel the product, the list price for the domain name will be deducted from the refund amount. The list price is the price of the domain name listed on our website and is not subject to any promotion, discount, or other reduction in price. In no event will you be eligible for more than one refund of the same product.

10.1 Non-refundable Products and Services.

We don’t offer a refund for the following services;
1. Domain Names (Registration or Transfers)
2. Our Domain add-ons (ID Protection, Email Forwarding and DNS management)
3. Hosting add-ons

11.0 GENERAL RULES OF CONDUCT

1. Your use of this Site and the Services, including any content you submit, will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations.
2. You agree to provide government-issued photo identification and/or government-issued business identification as required for verification of identity when requested.
3. You will not copy or distribute in any medium any part of this Site or the Services, except where expressly authorized by MakigoHost.
4. Below are some illegal manners that will put you in a serious trouble when using our service.
a. >> It is illegal or promotes or encourages illegal activity;
b. >> Promotes, encourages or engages in any form of pornography or the exploitation of children;
c. >> Promotes, encourages or engages in terrorism, violence against people, animals, or property;
d. >> Promotes, encourages or engages in any spam or other unsolicited bulk email, or computer or network hacking or cracking;

12.0 Our Backup Storage Policy

What is Backup Storage?

Backup storage is a separate storage that is allocated on our standby servers just for keeping backups for each cPanel account we have here at makigohost. Now if you are a reseller and you have 500 clients in Total for example, all these 500 clients cPanels are backed up Daily, Weekly and Monthly. Now if each cPanel grows to 20 GB in size multiply by the 500 clients that will be 10,000 GB = 10 TB backup storage needed for that reseller's account. Now calculating for Daily, Weekly and Monthly backup storage Needs based on our above example. "A reseller with 500 clients"

DAILY BACKUP
• 1. Sunday backup = 10 TB
• 2. Monday backup = 10 TB
• 3. Tuesday backup = 10 TB
• 4. Wednesday backup = 10 TB
• 5. Thursday backup = 10 TB
• 6. Friday backup = 10 TB
• 7. Saturday backup = 10 TB

Note that we don't delete these days backup until next week, let's explain; on Fridays, if you need last Sunday backup you will get because is still in the backup storage. So Total DAILY backup Storage needed for this Reseller with 500 clients = 10 TB x 7 days = 70 TB (and then saved as weekly backup) all the 7 days backups are kept safely and this becomes your weekly backup

WEEKLY BACKUP
• 1. Week 1 backup = 70 TB
• 2. Week 2 backup = 70 TB
• 3. Week 3 backup = 70 TB
• 4. Week 4 backup = 70 TB

Also remenber that we always keep 4 weeks backup until next Month, let's explain; on Week 4, if you need Week 1 backup you will get because is still in the backup storage. So Total WEEKLY backup Storage needed for this Reseller with 500 clients = 70 TB x 4 Weeks = 280 TB (and then saved as Monthly backup) all the 4 Weeks backups are kept safely and this becomes your Monthly backup NOTE Week 1 data will alway be more than Week 2, Week 2 data will be more than Week 3 and this applies to all the cycles Daily, Weekly and monthly, we hope this is clear? as clients continue to use their sites the data keeps increasing but let's use one figure just not to confuse you. Week 4 backup can even increase to 80 TB but let's stick to the 70 TB.

MONTHLY BACKUP
• 1. Month 1 backup = 280 TB
• 2. Month 1 backup = 280 TB

NOTE, we always keep 2 Months backup and delete them after the 3rd month, let's explain using January, Febuary and March, Lets say you made a mistake on March and wants to go back as far as January is still possible because by then January and Febuary data will still be in the our backup storage. So Total MONTHLY backup Storage needed for this Reseller with 500 clients = 280 TB x 2 Months = 560 TB (and then everything is deleted from the system finally)

WHAT IS OUR POLICY? To ensure we can continue offering unlimited and affordable reseller hosting, we’ve set a backup storage limit of 5 GB per cPanel account. Each cPanel account you have is eligible for up to 5 GB of JetBackup Storage. cPanels exceeding this limit will be automatically excluded from our backup system. NOTE: If your users are not uploading video files, in most cases 5 GB Backup Space is more than enough for each cPanel Daily, Weekly and Monthly Backups.

If a cPanel account exceeds 5 GB, resellers have 3 options:
1. Set up your own remote JetBackup destination (Google Drive, S3, FTP, etc.) you can learn how to do that here JetBackup Setup
2. Review such accounts to ensure the owners are not doing any of the following; (i). Storing heavy files (files like videos can be hosted on Google drive or Dropbox). (ii). Users might be keeping outdated zipped files and if so you can delete them if necessary to free up space. cPanel accounts that are always < or = 5GB will automatically be added to our backup systems.
3. Or purchase additional backup space from us whenever you need that. This policy helps us ensure long-term sustainability while giving you full control and flexibility over your data. Every Hosting company has this policy just that mostly it not made clear to users and sometimes they even hide this information until is too late. But we believe being transparent is a good thing to do.

13.0 Our "UNLIMITED" Storage Policy

Our unlimited storage offering is designed specifically to support the regular needs of websites—such as storing website files, databases, and emails. It is not intended to be used for purposes such as backup storage, file sharing/hosting services, multimedia archiving, or any form of data warehousing. Storing large quantities of compressed files, backups, videos or personal archives violates our Fair Usage Policy. If an account is found to be using storage in a way that adversely affects server performance or is inconsistent with normal website operations, we reserve the right to restrict, limit, or remove such usage to ensure optimal performance for all users.

14.0 You can't Host Financial, Banking or High-Risk Websites

The following categories of websites and online services are strictly prohibited on our platform:

1. Banking and Financial Services
a. Online banking portals
b. Electronic wallet or payment systems
c. Investment platforms
d. Loan or credit service platforms
e. Websites imitating or replicating legitimate financial institutions

2. Forex, Crypto, and Investment Platforms
a. Forex trading systems
b. Trading bots or automation tools
c. HYIP programs
d. Crypto investment dashboards
e. Profit-return or similar financial schemes

3. Betting, Gambling, and Gaming Websites
a. Sports betting platforms
b. Online casinos
c. Slot games, lotteries, and raffles
d. Any chance-based gaming service

4. Financial Look-Alike or Simulation Systems
a. Any website or app that imitates or simulates a financial institution
b. Any interface that resembles online banking or financial dashboards

5. Forbidden Words in Domain Names
Websites or domain names containing the following words are 100% forbidden on our servers, and no reseller should allow them:
"bank", "banking", "forex", "fund", "trade", "investment", "mining", "coin", "crypto" "wallet"

These categories are designated as high-risk due to a documented history of abuse, fraud, and phishing activities originating from such content. As a result, hosting these types of services is not permitted under any circumstances.

❤️ Exceptions
There are many legitimate companies that use the words "trade" or "trading" — Here are some few examples; UrbanTrade, MegaTrade Limited, TradeGlobe Transport, TradeTech Solutions, TradeDigital Labs, TradeGrid Systems etc — These businesses operate safely in industries like logistics, technology, import/export, digital services, and general commerce. The goal of the policy is not to ban the word “trade” entirely, but to prevent hosting of illegal, deceptive, or financial-trading websites that frequently appear in our abuse reports. If you need help identifying illegal clients' websites, let us know.

6. Additional High-Risk Activities
a. Hosting phishing pages, malware, or hacking tools
b. Running spam campaigns or bulk unsolicited email services
c. Any activity that may damage server reputation or lead to IP blacklisting

Enforcement
Any account hosting prohibited content may be immediately suspended or terminated without prior notice. To restore access, a reactivation/penalty fee of $50 per account will apply. Additional measures may be taken to protect the network, maintain IP reputation, and comply with legal or regulatory requirements.

Responsibility
Clients and resellers are fully responsible for ensuring all users under their accounts comply with this policy. Repeated violations may result in permanent revocation of reseller privileges.

⚠️ New Reseller Reminder
All new resellers will receive this policy upon signup. Hosting any prohibited content or allowing clients to violate this policy may lead to immediate suspension, a $50 reactivation fee, and possible termination of reseller rights. Resellers are strongly encouraged to actively monitor their clients to ensure full compliance.
